Terms of Service

These terms govern your use of thelawniq.com.au and shop.thelawniq.com.au (the Site) and any one-off purchase you make from us.

If you take out a subscription plan, our Subscription & Cancellation Policy also applies, and it prevails over these terms to the extent of any inconsistency.

1. Who we are

The Lawn IQ Pty Ltd, ABN 48 685 251 978, ACN 685 251 978, trading as The Lawn IQ, of 189 Kenny Rd, Chambers Flat QLD 4133.

2. Using the Site

You must be at least 18 years old to buy from us. You agree not to use the Site unlawfully, to interfere with it, or to attempt to access it in an unauthorised way.

3. Orders

When you place an order you are making an offer to buy. A contract is formed when we send your order confirmation. We may decline or cancel an order, and refund you in full, where:

  • the product is out of stock
  • there was an obvious pricing or description error
  • we cannot lawfully supply a chemical product to your state, territory or postcode
  • we reasonably suspect fraud or resale

4. Prices

All prices are in Australian dollars and include GST. The Lawn IQ Pty Ltd is registered for GST. Prices, products and promotions can change without notice, but changes do not affect an order we have already confirmed. Delivery charges are shown before you pay.

5. Discount codes

Discount codes are for the person or campaign they were issued to. Unless we state otherwise, they cannot be combined, resold, or applied to an order already placed, and we may withdraw a code at any time. Withdrawing a code does not affect a discount already applied to a confirmed order.

6. Product information

We describe our products as accurately as we can, including analysis, rates and coverage. Images are indicative. Formulations, suppliers and packaging change from time to time, and we may supply a product of equivalent or better specification.

We cannot guarantee a specific lawn result. Turf outcomes depend on rainfall, temperature, irrigation, soil, drainage, shade, mowing, wear, existing disease and pest pressure, prior treatments, and whether the plan is followed. Most of that is outside our control. This does not limit clause 9.

7. Chemical products

Some products we sell are agricultural chemicals registered with the Australian Pesticides and Veterinary Medicines Authority (APVMA).

  • Use them strictly according to the approved label. Using an agvet chemical contrary to its label is an offence under state and territory law. Our instructions supplement the label. If they ever conflict, follow the label.
  • A Safety Data Sheet is supplied with the product and available on request.
  • You are responsible for safe use, including wearing the personal protective equipment on the label, avoiding drift onto neighbouring properties, gardens, waterways and stormwater drains, and observing re-entry periods before people or pets return to treated areas.
  • Store in the original labelled container, secured, away from children, pets and food.
  • You must not resell, decant or give these products to anyone else.
  • Some products cannot be supplied to some states, territories or postcodes, or require a permit. We may substitute or omit them.

8. Intellectual property

We own or are licensed to use everything on the Site, including the GrowBot methodology, plan content, application schedules, product information, branding and written material. You may use it for your own personal, non-commercial purposes only. You must not copy, republish or resell it.

9. Your rights under the Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage, and to have goods repaired or replaced if they fail to be of acceptable quality and the failure is not major.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where a term would do so, it does not apply to that extent.

10. Our liability

  1. Nothing in these terms limits our liability under the Australian Consumer Law, for fraud, or for death or personal injury caused by our negligence.
  2. Subject to clause 10.1, we are not liable for loss or damage caused by failure to follow the product label or our instructions, application in weather the label warns against, inaccurate information you gave us, use on plants or surfaces the product is not intended for, pre-existing soil, drainage, pest or disease problems you did not disclose, or staining of pavers, concrete or decking where the label or our instructions warn of that risk.
  3. Subject to clause 10.1 and to the extent permitted by law, our total liability for any order is limited to the amount you paid for it.
  4. Subject to clause 10.1, neither party is liable for indirect or consequential loss.

11. Privacy

We handle your personal information in accordance with our Privacy Policy.

12. Changes to these terms

We may update these terms. The current version is always on the Site. Changes do not apply retrospectively to an order we have already confirmed. Where a change is material and adverse to a subscriber, we give 30 days notice under the Subscription & Cancellation Policy.

13. Complaints

Email hello@thelawniq.com. We acknowledge complaints within 2 business days and aim to resolve them within 10 business days. If we cannot, you can contact the ACCC at accc.gov.au or the Queensland Office of Fair Trading at qld.gov.au/fairtrading.

14. Governing law

These terms are governed by the laws of Queensland, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them. This does not limit your right to bring a claim in your own state or territory where the law allows it.

15. General

If any part of these terms is unenforceable it is severed and the rest continues. A failure to enforce a right is not a waiver of it. These terms, together with our Subscription & Cancellation Policy, Privacy Policy, Refund Policy and Shipping Policy, are the whole agreement between us.
