Version 1.2 路 Effective from 24 September 2026 路 Last updated 28 September 2026
1. Who we are and what these terms cover
These terms form a contract between you and The Lawn IQ Pty Ltd (ABN 48 685 251 978, ACN 685 251 978), trading as The Lawn IQ ("we", "us", "our"), of 189 Kenny Rd, Chambers Flat QLD 4133.
They apply to every Lawn IQ subscription plan you take out through thelawniq.com.au or shop.thelawniq.com.au (the Site), including the Lawn Master, Family Favourite and Eco Friendly Time Saver plans, and any seasonal or specialist plan we offer from time to time.
How you accept them. You accept these terms by ticking the acceptance box and completing checkout. No signature is required. We record the date you accepted, the version of these terms you were shown, and an acceptance reference against your subscription. That record is written once, is never overwritten, and we keep it for the life of your subscription and for seven years afterwards, so the version you agreed to can always be identified.
Please read these terms before you order. If you do not agree with them, do not start a subscription.
Separate terms apply to one-off purchases that are not part of a subscription. Our Privacy Policy, Shipping Policy, Refund Policy and Subscription & Cancellation Policy also form part of your agreement with us and are available on the Site.
We supply to Australian street addresses only.
2. Definitions
- ACL: the Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010 (Cth).
- Account: your customer account on the Site, where you manage your subscription.
- Annual Plan: a subscription taken out for a committed 12 month term, paid in full at the start, at a discounted and price-locked rate.
- Delivery Cycle: the quarter for which we ship a package of Products under your Plan. Your Growing Plan sets out when to apply each Product within the quarter, which varies by Plan.
- GrowBot: our online assessment tool that builds your Growing Plan from the information you give us.
- Growing Plan: the personalised lawn care schedule and product recommendations we generate for you through GrowBot and make available in your Account.
- Plan: the subscription plan you select.
- Plan Schedule: the plan description, price, billing cadence and included Products shown on the Site at the time you order, and confirmed in your order confirmation email. Schedule 1 to these terms sets out the standing arrangements that apply to every Plan.
- Products: the fertilisers, liquid treatments, soil and turf products, chemical products and hardware supplied under your Plan.
- Quarterly Plan: a subscription with no minimum term, billed every three months in advance, and cancellable under clause 11.
3. Eligibility
To take out a subscription you must:
- be at least 18 years of age;
- have an Australian street delivery address. We cannot deliver to a PO Box, a parcel locker or a freight forwarder;
- be acquiring the Plan for your own domestic or household lawn, unless we have agreed a commercial arrangement with you in writing; and
- give us accurate information about yourself and your lawn.
We may refuse or cancel an order where these requirements are not met, and we will refund you in full if we do.
4. How the subscription works
- You complete the GrowBot assessment. We use your answers, including grass type, location, shade, irrigation, soil and wear, to build your Growing Plan.
- You choose a Plan and a billing cadence (clause 5).
- We charge you in advance (clause 6) and dispatch Products to suit your lawn's season.
- Your Growing Plan, delivery schedule, application instructions and subscription settings are available at any time in your Account.
How often we deliver. A subscription is normally delivered four times a year, one package per quarter. It is not guaranteed to be exactly four. Where the quantities your lawn needs across a year are small enough that a single shipment covers them, you receive fewer and larger deliveries instead. The number of deliveries follows what your lawn needs, and your Growing Plan and order confirmation set out what you will receive and when.
Your Growing Plan is a recommendation based on the information you give us. It is not a site inspection and it is not a soil test. Its accuracy depends on the accuracy of what you tell us. If your lawn, grass type, irrigation or circumstances change, update your details in your Account so we can adjust your Plan.
5. Choosing your billing cadence
When you start a subscription you choose one of two cadences. We do not choose one for you, and the Quarterly Plan, which has no lock-in, is always available.
5.1 Quarterly Plan
- No lock-in and no minimum term.
- Billed every three months, in advance, before each Delivery Cycle.
- You can cancel at any time, subject to the 7 day cut-off in clause 11.
- Your price can change at renewal on at least 30 days notice (clause 7).
5.2 Annual Plan
- You commit to a 12 month term.
- In exchange you get 5% off the Quarterly Plan rate and a price lock for the full 12 months. We will not increase your price during the term, for any reason.
- You pay in full at the start of the term. Your deliveries are then released across the year as your Growing Plan requires.
- An Annual Plan cannot be cancelled during its term. Every delivery in the term ships and is charged, and you receive everything you have paid for. The Plan does not renew if you decline the next term under clause 7.
- The only way to exit an Annual Plan during its term is the 30 day return window in clause 9, or where you have rights under the ACL (clause 17). If you want the ability to stop at short notice, choose the Quarterly Plan.
6. Prices, payment and GST
- Every price, fee, refund, discount and threshold stated in these terms, on the Site, in your Account and in your order confirmation is in Australian dollars and is inclusive of GST, shown as a single total figure. We do not display a GST-exclusive price and we never add GST at a later step. The Lawn IQ Pty Ltd is registered for GST.
- Where to find your price. Your Plan price is calculated for your lawn and your Plan, and is displayed to you before you pay and at any time afterwards in your Account. The price shown in your Account and confirmed in your order confirmation email is the price that applies to your subscription. If a price displayed anywhere else on the Site differs from it, the price in your order confirmation governs. If we have made an obvious pricing error we will contact you before charging you, and you may cancel without penalty.
- Delivery charges are set out in Schedule 1 and shown at checkout before you pay.
- You authorise us, and our payment provider, to charge your nominated payment method for the amounts due under your Plan, in advance, on the cadence you chose. This authority continues until your subscription ends and all amounts are paid.
- You must keep a valid payment method on file. You can update it in your Account at any time.
- If a payment fails, clause 12 applies. We do not charge a fee for a failed payment.
7. Renewal and price changes
Both cadences renew automatically, and renewal is annual for both. A Quarterly Plan is billed every three months but is re-priced and renewed once a year; an Annual Plan is billed and renewed once a year. Your Plan keeps running until you decline a term or cancel it.
We will never re-lock you into a new term without telling you first. We give you at least 30 days notice before a term ends and before any price change takes effect, and we follow that up by email 28 days, 21 days and 14 days before the renewal date, so you always have more warning than the cancellation cut-off in clause 11 requires. That notice tells you the new price and the date it starts.
You can then:
- decline the next term, in which case your subscription ends at the end of the term you are in and nothing further is charged; or
- do nothing, in which case the next term starts at the price we told you about.
Declining applies to the next term. It does not end the term you are already in, and on an Annual Plan it cannot: see clause 5.2.
If we did not give you notice with a usable window to cancel, we do not apply the increase at that renewal. Your price stays where it is for a further term and the change is put to you properly at the next renewal.
Your Annual Plan price is locked for the whole of its term. We never apply a price increase to a Delivery Cycle you have already paid for.
Each renewal issues a fresh subscription agreement at the renewed price, which we email to you.
8. Changing your Plan
You can upgrade, downgrade or change your Plan through your Account or by emailing us, subject to availability.
- On a Quarterly Plan, changes take effect from your next Delivery Cycle.
- On an Annual Plan, you can upgrade at any time and we will charge the difference. A downgrade takes effect at the end of the term, because your price and your discount were set on the basis of the Plan you chose.
Changes requested less than 7 days before a scheduled delivery may not apply until the following cycle, because we pick, pack and book freight ahead of the delivery date.
9. The 30 day return window
This is our returns rule for every product we sell, whether it came on a subscription or as a one-off purchase. For a subscription it is also the only mid-term exit, and for an Annual Plan it is the only exit at all.
- You have 30 days from the delivery date to ask us for a return, not from the order date. The 30 days applies to your request reaching us, not to the goods getting back to us.
- Products must be unopened, undamaged and in perfect resaleable condition, in their original packaging.
- A 20% restocking fee applies to the goods you return. It is deducted from the GST-inclusive price you paid for those goods. It is not a separate charge and no GST is added on top of it.
- The restocking fee applies only to goods you actually send back. It is never applied to a quarter that was never delivered to you.
- Return postage is at your expense. Our products are heavy and freight is a real cost.
- We refund you after the goods have been returned to us and inspected.
Ask us for a return first, by emailing hello@thelawniq.com. Items sent back without an approved return cannot be processed.
Opened chemical products can never be returned, for safety and regulatory reasons. Contact us first and we will arrange safe handling. Do not post them to us.
9.1 How we work out your refund
Where you exit a subscription under this clause, your refund is:
- the full value of every quarter that has not been delivered to you, with no restocking fee applied to it; plus
- 80% of the value of the delivered goods you return in accordance with this clause.
Return postage is your cost and is not refunded. The original delivery charge is not refunded on a change of mind return.
This return window is something we offer voluntarily. It is in addition to, and does not limit, your rights under the ACL (clause 17). Where a product is faulty, damaged, unsafe, not as described, or is not what you ordered, clause 18 applies instead: there is no restocking fee and we pay the return freight.
10. Pausing and rescheduling
If you need to pause a Plan or move a delivery rather than cancel (because you are going away or moving house, or your lawn has changed), contact us at hello@thelawniq.com and we will work it out with you. As with cancelling, tell us at least 7 days before a scheduled delivery.
- Quarterly Plan: we can pause billing and deliveries. You are not billed while paused.
- Annual Plan: the term is already paid for, so a pause reschedules deliveries within the term rather than reducing what you receive or what you have paid. It does not shorten or end the term.
We may decline a pause where it would leave your lawn without a required seasonal application, but we will tell you why.
11. Cancelling a Quarterly Plan
Cancelling is as easy as signing up. You can cancel:
- through the subscription settings in your Account; or
- by emailing hello@thelawniq.com.
We do not require a phone call, a retention conversation, or a written letter.
11.1 The cut-off
The cut-off is 7 days before your next billing date, measured in the local time of the property your Plan was built for. We set it there because we pick, pack and book freight ahead of the delivery date.
- 7 or more days before the charge: that charge does not happen. Your subscription ends at that billing date, and you keep everything you have already paid for.
- Inside the 7 days: that charge is taken and the goods it covers are supplied, and your subscription then ends one quarter later.
11.2 What cancellation does and does not refund
Cancelling stops future payments. It does not by itself refund a payment already taken, because you still receive the Delivery Cycle that payment covers, so an ordinary quarterly cancellation carries no refund. Clause 9 and clause 17 are unaffected.
11.3 Annual Plans
An Annual Plan cannot be cancelled during its term (clause 5.2). You can decline the next term under clause 7, and clause 9 and clause 17 remain available to you.
11.4 Access to your Growing Plan
Your Growing Plan remains available in your Account for 90 days after your subscription ends, so you can finish the season. After that we may archive it.
12. Missed payments
If a scheduled payment fails, we retry it and email you so that you can update your payment details.
- After three consecutive failed attempts we pause your subscription. Pausing stops billing, which also stops deliveries.
- We never cancel a subscription for non-payment. A paused subscription keeps your Plan, your Growing Plan and your delivery schedule, and it resumes as soon as you update your payment method. A cancellation would mean starting again from checkout and losing your schedule, so we do not do it.
- We will never keep charging a card that has told us to stop.
13. Delivery
- Delivery timeframes shown on the Site are estimates, not guarantees. We are not responsible for carrier delays outside our control, but we will help you chase them.
- We deliver to Australian street addresses only. We cannot deliver to a PO Box, a parcel locker or a freight forwarder.
- Delivery is free on orders of $100 and over, and $18 flat below that, calculated on the shippable value of the order. Both figures include GST. There is no additional regional or remote-area charge.
- Risk in the Products passes to you on delivery. Title passes on delivery or on payment in full, whichever is later.
- You must provide a safe, accessible delivery location. Where you give an authority to leave, you accept the risk of loss or damage after the Products are left.
- If a delivery is returned to us because the address was wrong or nobody accepted it, we may charge you the actual redelivery cost.
- Tell us within 7 days if a delivery does not arrive or arrives damaged, and we will resolve it under clause 18. Telling us late does not remove your rights under the ACL; it only makes a claim against the carrier harder.
14. Substitutions and availability
Product formulations, suppliers and seasonal availability change. We may substitute a Product in your Plan for one of equivalent or better specification and equivalent or greater value. Where we do, we will tell you and update your Growing Plan and application instructions.
If we cannot supply a materially equivalent Product and you do not accept the substitute, you may cancel the affected Delivery Cycle and we will refund it in full, with no restocking fee.
15. Chemical products: your obligations
A Plan may include agricultural chemical products registered with the Australian Pesticides and Veterinary Medicines Authority (APVMA), in any of these categories: insecticide, herbicide, pre-emergent herbicide and plant growth regulator. Which of them appear in your Plan, and in which delivery, is set by your Growing Plan and confirmed in your order confirmation. These clauses are important and are not negotiable.
- Use strictly according to the label. The approved label supplied with the Product sets the legal conditions of use. Using an agvet chemical contrary to its label is an offence under state and territory law. Our application instructions supplement the label. They do not replace it. If our instructions and the label ever conflict, follow the label.
- Safety Data Sheets. An SDS is available for every chemical Product we supply. It is provided with the Product and on request from hello@thelawniq.com.
- You are responsible for safe use, including wearing the personal protective equipment stated on the label, avoiding spray drift onto neighbouring properties, gardens, waterways and stormwater drains, and observing the re-entry period before allowing people or pets back onto treated areas.
- Storage. Store chemical Products in their original labelled container, secured, out of reach of children and pets, away from food, and as directed on the label.
- Do not on-supply. You must not resell, decant or give these Products to anyone else.
- State and territory restrictions. Some Products cannot be supplied to some states, territories or postcodes, or require a permit or licence. Where a restriction applies we may substitute or omit that Product from your delivery and adjust your Growing Plan. We will tell you when we do.
- Freight. The chemical Products we supply are packed in consumer quantities and are not consigned as dangerous goods. Some carriers still restrict how these Products are carried, particularly by air and to remote areas, so delivery to some locations may take longer or use a different carrier.
- Not suitable for everyone. If anyone at the property has a relevant health condition, or you are pregnant, seek medical advice before handling chemical Products. You can ask us to remove chemical Products from your Plan at any time and we will rebuild it around fertiliser and biostimulant inputs.
Poisons Information Centre: 13 11 26 (24 hours, Australia-wide).
16. What we promise, and what depends on you
We will:
- build your Growing Plan with reasonable care and skill, using the information you give us;
- supply Products that match their description and are fit for the purpose they are sold for;
- ship on the schedule in your Plan Schedule; and
- support you through hello@thelawniq.com when something is not working.
We cannot guarantee a specific lawn result. Turf outcomes depend on rainfall, temperature, irrigation, soil, drainage, shade, mowing height and frequency, wear, existing disease and pest pressure, prior treatments, and whether the Plan is actually followed. Most of these are outside our control and outside yours.
Nothing in this clause limits the consumer guarantees in clause 17. If our Growing Plan is not prepared with due care and skill, or a Product is not of acceptable quality, you have rights under the ACL and we will honour them.
17. Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion.
For goods, you are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
These rights apply to discounted and sale items in exactly the same way as to full-price ones. A discount, including the Annual Plan discount, does not remove them.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the ACL or any other law that cannot lawfully be excluded. Where any term of this contract would do so, that term does not apply to that extent. That includes the Annual Plan commitment in clause 5.2 and the restocking fee in clause 9: neither applies where your right arises under the ACL.
18. Faulty, damaged, incorrect or missing goods
Contact hello@thelawniq.com with your order number and, where relevant, photos. Where a Product is faulty, damaged, unsafe, not as described, or is not what you ordered, or where a delivery does not arrive:
- we will repair, replace or refund it, as the ACL requires;
- no restocking fee applies; and
- we pay the return freight.
Do not use a Product you believe is faulty. Store it safely and keep the packaging and label. You do not need to return an item before we resolve it where returning it is impractical, for example where the Product is hazardous or has been part-applied. Contact us and we will tell you what we need. If a chemical Product is faulty, do not post it to us; contact us first and we will arrange safe handling.
This clause does not limit your rights under clause 17.
19. Our liability
- Nothing in these terms limits our liability under the ACL, for fraud, or for death or personal injury caused by our negligence.
- Subject to clause 19.1, we are not liable for loss or damage caused by: your failure to follow the product label, our application instructions or your Growing Plan; application in weather conditions the label warns against; inaccurate or incomplete information you gave us about your lawn; use of the Products on plants, turf varieties or surfaces they are not registered or intended for; pre-existing disease, pest, soil, drainage or irrigation problems you did not disclose; or staining of pavers, concrete, decking or other surfaces where the label or our instructions warn of that risk.
- Subject to clause 19.1, and to the extent permitted by law, our total liability arising out of your subscription in any 12 month period is limited to the amount you paid us in that period.
- Subject to clause 19.1, neither party is liable to the other for indirect or consequential loss.
20. Your obligations
You agree to:
- give us accurate information about your lawn and keep it current in your Account;
- follow the product label and the application instructions in your Growing Plan;
- keep your Account login secure and tell us if it is compromised;
- not resell Products supplied under your Plan; and
- not use the Site or our content unlawfully.
21. Your Account
You are responsible for activity on your Account. We may suspend or close an Account where we reasonably believe it is being used fraudulently, unlawfully, or in breach of these terms. Where we do, we will tell you why and refund any amount you have paid for undelivered Products, unless the breach involved fraud.
22. Intellectual property
We own, or are licensed to use, everything on the Site and in your Growing Plan, including the GrowBot methodology, plan content, application schedules, product information, branding and written material.
Your Growing Plan is licensed to you for use on your own property, for as long as your subscription is active and for the access period in clause 11.4. You must not copy, publish, resell or commercially exploit it.
23. Privacy and marketing
- We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
- To deliver your Plan we collect and use information about you and your property, including your address, grass type, irrigation, shade, soil and lawn condition, and we share what is necessary with our payment provider, freight carriers and fulfilment partners.
- We send marketing communications only where you have consented or where the law otherwise permits, consistent with the Spam Act 2003 (Cth). Every marketing message includes a working unsubscribe. Unsubscribing from marketing does not stop essential service messages about your deliveries, payments or Plan.
- You can request access to, or correction of, your personal information by emailing hello@thelawniq.com.
24. Changes to these terms
- We may update these terms. We will publish the updated version on the Site and update the version and date at the top of this page.
- Where a change is material and adverse to you, we will give you at least 30 days notice by email before it applies to your subscription. If you do not accept it, you can cancel under clause 11 before it takes effect.
- An update does not change the price or the term of an Annual Plan you are already in. A material adverse change applies to an Annual Plan only from its next term, which you may decline under clause 7.
- Changes do not apply retrospectively to a Delivery Cycle you have already paid for.
25. Suspension and cancellation by us
We may pause your subscription where a payment fails, as described in clause 12.
We may cancel your subscription if:
- you materially breach these terms, including the chemical obligations in clause 15, and do not fix it within 14 days of us asking you to;
- we reasonably believe the Products are being resold or misused; or
- we permanently discontinue the Plan, in which case we will give you at least 30 days notice.
Except where you have acted fraudulently, we will refund amounts you have paid for Products not yet delivered, in full and with no restocking fee.
26. Complaints and disputes
Contact us first at hello@thelawniq.com. We will acknowledge your complaint within 2 business days and aim to resolve it within 10 business days.
If we cannot resolve it, you can contact the ACCC at accc.gov.au, or your state or territory consumer affairs or fair trading office. In Queensland that is the Office of Fair Trading at qld.gov.au/fairtrading.
Nothing in this clause prevents either of us from seeking urgent relief from a court.
27. General
Governing law. These terms are governed by the laws of Queensland, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them. This does not limit your right to bring a claim in your own state or territory where the law allows it.
Assignment. You may not transfer your subscription without our written consent. We may assign this contract to a purchaser of our business, provided your rights and your price are not reduced.
Events outside our control. Neither party is liable for a failure to perform caused by an event beyond its reasonable control, including natural disaster, extreme weather, fire, flood, pandemic, industrial action, carrier failure or supply chain disruption. Where such an event delays your deliveries by more than 30 days, either party may end the subscription and we will refund amounts paid for undelivered Products, in full and with no restocking fee.
Severance. If any part of these terms is unenforceable, it is severed and the rest continues to apply.
Waiver. A failure to enforce a right is not a waiver of it.
Entire agreement. These terms, your Plan Schedule, your subscription agreement, and our Privacy Policy, Shipping Policy, Refund Policy and Subscription & Cancellation Policy are the whole agreement between us about your subscription.

Schedule 1: Plan Schedule
Plan prices are calculated for each customer's lawn and Plan by our system. They are displayed before purchase and at any time afterwards in your Account, and are confirmed in your order confirmation email. That confirmed price governs the subscription (clause 6.2).
The following applies to every Plan.
- Plans: Lawn Master, Family Favourite, Eco Friendly Time Saver.
- Billing, Quarterly Plan: every three months, paid in advance.
- Billing, Annual Plan: 12 months, paid in full at the start of the term.
- Annual Plan discount: 5% off the Quarterly Plan rate, plus a price lock for the full 12 months.
- Deliveries: normally four a year, one package per quarter. Fewer and larger deliveries where a year's quantities for your lawn fit in a single shipment (clause 4).
- Cancellation cut-off, Quarterly Plan: 7 days before the next billing date, in the property's local time. An Annual Plan cannot be cancelled during its term.
- Return window: 30 days from the delivery date to request a return, unopened and resaleable, 20% restocking fee on returned goods, return postage at your cost.
- Renewal notice: at least 30 days, with reminders at 28, 21 and 14 days.
- Currency and GST: Australian dollars, GST inclusive, stated as a single figure.
- Delivery: free on orders of $100 and over, $18 flat below that, on the shippable value of the order. Australian street addresses only.
What a Plan contains. Every Plan is built to your lawn, so the Products supplied, their quantities and their timing are set by your Growing Plan and confirmed in your order confirmation. A Plan includes fertiliser and soil and turf inputs such as a wetting agent or biostimulant, and may include any of the registered chemical categories in clause 15: insecticide, herbicide, pre-emergent herbicide and plant growth regulator. Where a plant growth regulator is included, the particular registered product is selected for your lawn and named on the delivery it arrives in.
